These Terms of Service (“Terms”) are a legally binding agreement between you (“User” or “you”) and Better Health Labs, Inc., doing business as Measured (“Measured,” “we,” “our,” or “us”). By accessing the Platform, you acknowledge that you have read, understood, and agree to be bound by all provisions below.
1. Definitions
To keep the language precise, we use a few defined terms throughout these Terms. Each term listed below has the meaning stated here and carries that meaning whenever it appears with initial capital letters.
Platform — All websites, mobile applications, APIs, and communication channels controlled by Measured.
Subscription — The recurring cash-pay membership plan that bundles asynchronous MD/NP care, labs, and prescription coordination.
Bridge — Cloud Health Medical Group, P.C. and its state affiliates that furnish insurance-covered Registered-Dietitian (“RD”) visits.
Measured-Affiliated Medical Groups — Coastal Care Medical Group, P.A. (FL); Coastal Care Medical Group of California, P.C.; and Coastal Care Medical Group of New Jersey, P.C.
2. Acceptance & Incorporated Documents
You accept these Terms, together with the documents listed below, by clicking “I Agree,” creating an account, making a purchase, or using any part of the Platform. These incorporated documents form part of the contract just as if they were set out in full:
Bridge Assignment of Benefits & Bridge Consent to Treat (for insured RD visits)
Measured may revise these Terms periodically. When that happens, we will update the “Last Updated” date above and provide notice by email or in-app banner if changes are material. Continued use after the effective date of any revision constitutes your acceptance of the updated Terms.
2A. Accuracy, Completeness & Timeliness of Information
We are not responsible if information made available on the Platform is not accurate, complete, or current. Any reliance on the material is at your own risk. Historical information may not be current, and we reserve the right to modify the Platform’s content at any time without obligation to update users.
3. Eligibility & Geographic Scope
The Platform is intended for adults who are between the ages of eighteen (18) and sixty five (65) years old and physically present in the United States at each use. By using the Platform, you represent that you satisfy these requirements and will not attempt to access our services from outside the United States, including by VPN or similar technology.

Measured itself does not practice medicine. All clinical care on the Platform is provided by licensed professionals employed or contracted by Bridge or the Measured-Affiliated Medical Groups, as applicable.
4A. Products or Services Disclaimer
We make reasonable efforts to describe our services and offerings as accurately as possible. However, we do not guarantee that service descriptions, pricing, availability, or other content is error-free, complete, or current. We reserve the right to modify or discontinue any product or service at any time without notice.
5. No Emergency Use
The Platform is not appropriate for emergency or life-threatening conditions. If you think you are experiencing a medical emergency — such as chest pain, severe shortness of breath, or uncontrolled bleeding — call 911 or go to the nearest emergency department without delay.
6. User Account Obligations
You agree to furnish accurate, current, and complete information during registration and to maintain the security of your credentials at all times. You further agree to update any change to your address, insurance, or payment method within ten (10) days and to notify careteam@trymeasured.com immediately if you suspect unauthorized use of your account.
6A. Prohibited Uses
You agree not to use the Platform:
For any unlawful purpose or to solicit others to perform unlawful acts.
To infringe upon our intellectual property or that of others.
To harass, abuse, insult, harm, defame, slander, intimidate, or discriminate.
To upload or transmit viruses or any malicious code.
To collect or track personal information of others without consent.
To use bots, crawlers, scrapers, or similar automated tools without express permission.
For any obscene or immoral purpose.
To interfere with or circumvent the security features of the Platform.
We reserve the right to terminate your use for violating any prohibited use.
7. Payments, Refunds & Six-Month Guarantee
7.1 Authorization
By adding a credit or debit card, you authorize Measured (through Stripe or Braintree) to charge all membership, medication, and laboratory fees that are not covered by insurance. You also promise that any payment method you use is valid and that you have authority to authorize charges on that account.
7.2 Price Changes
Measured may change Subscription prices with thirty (30) days’ prior written notice delivered to the email on file. If you do not agree to the new price, you must cancel before the new rate takes effect; otherwise, continued use constitutes acceptance.
7.3 Standard Refund Policy
Except where prohibited by law or explicitly stated otherwise, fees become non-refundable once a licensed clinician has reviewed your medical intake or once medication has shipped. Shipping and handling fees are always non-refundable after dispatch.
7.4 Six-Month Money-Back Guarantee
We want the program to work for you. If you meet the criteria in the table below and still lose less than 5% of your starting weight, we will refund 100% of all fees paid to Measured during the first six months of membership. You must submit your request between day 181 and day 210 by emailing careteam@trymeasured.com with the subject “6-Month Guarantee.”

Approved refunds are processed to the original payment method within fifteen (15) business days.
7.5 Insurance Billing for RD Visits
Whether part of the structured program or stand-alone, every RD encounter is billed directly to your health plan by Bridge. You are responsible for any copay, coinsurance, or deductible imposed by your insurer.
7.6 Stand-Alone RD Option
Patients who wish to see an RD without subscribing may email careteam@trymeasured.com with the subject “RD-Only Visit.” Our staff will arrange an appointment with an in-network provider. Measured will not charge any membership or administrative fee for this visit; you pay only the normal insurance cost-share.
7.7 Promotional Offers
From time to time, Measured may offer promo codes or introductory trials. Promotions are limited to the term stated in the offer and automatically convert to the then-current standard rate unless canceled before the promotional period ends.
8. SMS Marketing (TCPA)
If you opt in to SMS messaging, you expressly consent to receive recurring, autodialed marketing and transactional texts. Message and data rates may apply. You can cancel at any time by texting STOP, and you can obtain help by texting HELP.
9. Intellectual Property & DMCA
All text, graphics, software, and other content on the Platform are owned by Measured or its licensors and protected by law. You receive a limited, revocable, non-exclusive license to use the Platform for personal, non-commercial purposes.

10. Third-Party Links
The Platform may link to websites or services not operated by Measured. We do not control and are not responsible for third-party content, security, or privacy practices. Use of third-party sites is at your own risk.
11. No Warranties
THE PLATFORM AND ALL SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” MEASURED DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. NO ORAL OR WRITTEN ADVICE SHALL CREATE ANY WARRANTY NOT EXPRESSLY STATED HERE.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MEASURED SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, OR DATA. MEASURED’S AGGREGATE LIABILITY IN ANY 12-MONTH PERIOD SHALL NOT EXCEED THE GREATER OF (A) USD $500 OR (B) THE AMOUNT YOU PAID TO MEASURED IN THAT PERIOD.
13. Indemnification
You agree to defend, indemnify, and hold harmless Measured, its officers, directors, employees, and agents from any claim or demand arising from your misuse of the Platform, your breach of these Terms, or your violation of any law or third-party right.
14. Dispute Resolution & Class-Action Waiver
Except for small-claims matters or requests for injunctive relief, disputes will be resolved by binding arbitration administered by JAMS under its Streamlined Rules. The arbitration will take place in San Francisco, California, or by secure video conference, and class actions are prohibited.
15. Force Majeure
Measured is not liable for any delay or failure to perform caused by events beyond reasonable control, including natural disasters, labor disputes, war, civil unrest, epidemics, or internet service disruptions.
16. Assignment | Severability | Entire Agreement
Measured may assign these Terms without notice; you may not assign without our prior written consent. If any provision is held unenforceable, the remaining provisions remain effective. These Terms and incorporated documents constitute the entire agreement between you and Measured regarding the Platform.
17. Governing Law
These Terms are governed by the laws of the State of California, without regard to conflict-of-laws principles. The Federal Arbitration Act governs the enforceability of the arbitration clause.
